NV S.B. 352 - Introduced Mar. 17, 2003

This bill designates the Nevada Cancer Institute as the official cancer institute of the State of Nevada and appropriates $1.5 million from the State General Fund to the University of Nevada, Las Vegas for the development of an oral cancer and forensic institute. The funding supports infrastructure necessary to advance oral cancer research and education in the state.

Nevada law presumes laryngeal and pharyngeal cancer to be occupational diseases for firefighters, fire investigators, and hazardous materials instructors with at least five years of service who were exposed to carcinogens such as arsenic, asbestos, benzene, diesel exhaust, soot, formaldehyde, and hydrogen chloride. These cancers are deemed work-related unless proven otherwise, and eligible individuals are entitled to medical benefits and other compensation depending on employment status and timing of diagnosis.

This bill would require Nevada firefighters and volunteer firefighters to undergo annual cancer screenings as a condition for industrial insurance coverage for cancer, including nasopharyngeal cancers such as laryngeal and pharyngeal cancer. These cancers are presumed to arise from occupational exposure to carcinogens like arsenic, asbestos, benzene, diesel exhaust, soot, formaldehyde, and hydrogen chloride. The bill enhances prior law by mandating proactive screening and establishes that laryngeal and pharyngeal cancer are compensable occupational diseases for eligible personnel under specified conditions.
