This bill proposes changes to the Nebraska Workers’ Compensation Act to make certain cancers presumed compensable as occupational diseases for firefighters, including those who are retired. It establishes a rebuttable presumption that cancers—such as oral, esophageal, nasopharyngeal, and others—arose out of employment if linked to carcinogens like diesel exhaust or formaldehyde, known to be present in firefighting environments. The bill defines both professional and volunteer firefighters and sets timeframes post-employment for the presumption to apply, depending on years of service. Only medical benefits are available for post-retirement claims under certain conditions.
